Terms of Service

These Terms govern use of Neonyx Group websites, applications, and the Neonyx Group AI Assistant for Discord.

1. Acceptance and Scope

By accessing or using a Neonyx Group website, web application, Discord application, bot, or related service (collectively, the "Service"), you agree to these Terms of Service. If you use the Service for an organization or Discord server, you represent that you have authority to act for that organization or server.

If you do not agree to these Terms, do not use the Service.

2. The Service

Neonyx Group provides software, automation, AI-assisted workflows, websites, private tools, demonstrations, and Discord-based agent experiences. Features may include commands, conversational assistance, document or media handling, task routing, summaries, notifications, and integrations selected by an authorized administrator.

Some features are prototypes, demonstrations, or limited-access tools. Labels and notices shown in the Service form part of these Terms.

3. Eligibility and Accounts

You must meet the minimum age required by Discord and by the laws where you live. You are responsible for activity performed through your account and for keeping your credentials secure. Neonyx Group will never ask you to provide your Discord password or user token.

4. Discord and Third-Party Terms

Use of the Discord App also remains subject to the Discord Terms of Service, Discord Community Guidelines, and applicable server rules. Discord and other integrations are third-party services. Their availability, security, and policies are controlled by their respective providers.

5. Authorized and Acceptable Use

You may use the Service only for lawful, authorized purposes. You may not:

  • attempt to obtain another person's credentials, private data, or access;
  • circumvent permissions, approvals, safety controls, rate limits, or access restrictions;
  • use the Service to harass, threaten, exploit, deceive, or unlawfully discriminate;
  • upload malware, infringing material, or content you are not authorized to use;
  • use the Service for unlawful surveillance, spam, unsolicited marketing, or data scraping;
  • interfere with the Service, Discord, connected systems, or other users; or
  • use outputs as the sole basis for high-impact medical, legal, financial, employment, housing, insurance, or safety decisions.

Server administrators are responsible for configuring channels, roles, permissions, and access in a way that is appropriate for their communities.

6. Your Content

You retain ownership of content you submit. You grant Neonyx Group a limited, non-exclusive license to process, transmit, format, and display that content only as needed to provide, secure, troubleshoot, and maintain the Service. You represent that you have the rights and permissions needed to submit the content.

Do not submit sensitive personal information, protected health information, financial account data, passwords, private keys, or confidential material unless an authorized Neonyx Group workflow specifically requests and protects it.

7. AI-Generated Output

AI-generated responses may be incomplete, inaccurate, outdated, or unsuitable for your situation. Review important output before relying on it or sharing it. You remain responsible for decisions, actions, and content produced through your use of the Service.

The Service may require approval before executing commands or external actions. Do not treat the absence of an approval prompt as a guarantee that an action is safe or correct.

8. Privacy

Our Privacy Policy explains what information we collect, how we use it, how AI processing works, and how to request access or deletion. By using the Service, you acknowledge those practices.

9. Changes, Availability, and Suspension

We may change, limit, suspend, or discontinue features to maintain security, comply with law or platform rules, address abuse, or improve the Service. We may restrict or terminate access when we reasonably believe these Terms have been violated or the Service is being used in a harmful manner.

You may stop using the Service at any time. A Discord server administrator may remove the Discord App through Discord's controls.

10. Intellectual Property

The Service, its software, branding, interface, and original materials are owned by Neonyx Group or its licensors. These Terms do not transfer ownership of the Service or grant permission to copy, resell, reverse engineer, or create unauthorized derivative services.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." Neonyx Group does not warrant that the Service will be uninterrupted, error-free, secure, or suitable for every purpose, or that AI-generated output will be accurate.

12. Limitation of Liability

To the fullest extent permitted by law, Neonyx Group and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from use of the Service. Where liability cannot be excluded, total liability will not exceed the amount you paid Neonyx Group for the affected Service during the previous 12 months, or USD $100 if you paid nothing.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

13. Changes to These Terms

We may update these Terms as the Service or applicable requirements change. We will revise the date above and provide additional notice when a material change reasonably requires it. Continued use after an update takes effect constitutes acceptance of the updated Terms.
